These Terms of Service ("Terms") govern your use of swapmehub.com and its AI tools (the "Service"), operated by SWAP-ME ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use SWAP-ME. By using the Service, you confirm that you meet this requirement and that any information you provide is accurate.

2. Your Account

You sign in to SWAP-ME using Google Sign-In. You are responsible for maintaining the security of the Google account linked to your SWAP-ME account and for all activity that occurs under it.

3. Acceptable Use

You agree not to use SWAP-ME to create, upload, or generate content that:

• Depicts a real person in a sexual, nude, or otherwise non-consensual manner without that person's explicit permission
• Is used to harass, defame, impersonate, or bully any individual
• Is intended to deceive others, including political disinformation or fraudulent impersonation
• Depicts minors in any sexualized context
• Infringes on another person's copyright, trademark, or other intellectual property rights
• Violates any applicable law

You are solely responsible for the content you upload and generate. You confirm that you have the right and any necessary consent to use any photo, likeness, or content you submit to the Service. We reserve the right to suspend or terminate accounts that violate this policy, remove violating content, and report unlawful activity to relevant authorities where appropriate.

4. AI-Generated Content

SWAP-ME uses third-party AI providers (including Replicate and LightX) to process your uploads and generate results. Generated content may not always be accurate, appropriate, or free of errors, and results may vary. You use generated content at your own discretion and risk.

5. Gems and Virtual Currency

Gems are a virtual currency used within SWAP-ME to access certain tools and features. Gems have no cash value, are non-transferable, and are non-refundable except where required by law. We may adjust gem pricing, costs, or the free daily claim amount at any time.

6. Your Content and Our License

You retain ownership of the photos and content you upload. By uploading content, you grant us a limited license to process, store, and display that content solely for the purpose of operating the Service (for example, generating your results and displaying them in your gallery). We do not claim ownership of your uploaded or generated content.

7. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms. You may stop using the Service and request account deletion at any time.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated results will meet your expectations.

9. Limitation of Liability

To the fullest extent permitted by law, SWAP-ME shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
